Terms of Use — Lake Cumberland

These terms are an agreement between you and Valleyside Electronics LLC, a Kentucky limited liability company ("we", "us"), which publishes the Lake Cumberland app ("the app"). By installing or using the app you agree to them. If you don't agree, please don't use the app.

Using the app on the water

The app helps you find ramps, marinas and spots, see the lake level and weather, and plan a way across the lake. It is a guide, not a navigation instrument.

• Routes don't know depth, stumps, buoys, no-wake zones or other boats. The shoreline moves with the lake level. Always keep a lookout, follow posted markers and navigation rules, and use your own judgment.
• Information can be out of date or wrong. Lake levels, releases, forecasts and gauges come from government sources and can be hours old. Ramp, marina and event details come from public sources, venues and other boaters. Check with the source when it matters.
• In an emergency, call 911. Don't rely on the app to get help.

You are responsible for your boat, your passengers and your safety.

Reports you share

You can choose to share hazard reports, ramp readings and events so other boaters can see them. When you share something:

• You confirm it is true to the best of your knowledge and that you have the right to share it.
• You give us permission to store it, show it to other users of the app, and edit or remove it, at no cost and for as long as it is useful. It is shown without your name.
• Don't share anything false, misleading, unlawful, hateful, harassing, sexual, or advertising, or anything that includes someone's personal information.

We review reports and may remove any of them, and stop accepting reports from a phone, at our discretion. Other users can flag a report; flagged reports are hidden until we review them. To report a problem, use the flag button in the app or email support@valleyside.dev.

Membership cards

Some organizations (for example a towing service) issue membership cards you can keep in the app. The card, the membership and any service behind it come from that organization, not from us. Questions about a membership go to the organization that issued it. The app checks that a card is genuine; it does not guarantee the service.

Purchases

The optional one-time upgrade is sold through Google Play or the App Store and is subject to their terms, including their refund policies. It unlocks the feature on the account you bought it with; it is not a subscription.

Our app and content

The app, its design and its code belong to Valleyside Electronics LLC. We give you a personal, non-transferable right to use the app on devices you own or control. Don't copy, resell, reverse engineer, or misuse the app or its services, or try to get around its limits.

Map data is © OpenStreetMap contributors (Open Database License), with other sources credited on the app's About screen.

No warranty

The app is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise the app will be error-free, uninterrupted, or that information in it is accurate or complete.

Limitation of liability

To the fullest extent the law allows, Valleyside Electronics LLC is not liable for any indirect, incidental, special or consequential damages, or for any loss, injury or damage arising from your use of the app or reliance on its information. Our total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim, or $10 if you paid nothing.

App Store terms

If you got the app from Apple's App Store:

• These terms are between you and Valleyside Electronics LLC, not Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
• Apple is not responsible for addressing any claims about the app, including product liability claims, claims that it fails to meet legal requirements, or consumer protection claims, or for any claim that it infringes someone else's intellectual property.
• You confirm you are not in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes and ending

We may update these terms. The new version will be posted at this address with a new effective date, and continuing to use the app means you accept it. You can stop using the app at any time by uninstalling it. We may stop offering the app or any part of it.

Law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Kentucky, unless the law where you live gives you the right to bring it elsewhere.
